Why it works this way

Today a recognized jeonse fraud victim who receives auction dividends and public rental support still has no floor on how much of the deposit comes back. A junior-ranked tenant with almost no dividend and housing-only support can lose most of the deposit.

What changes: the State guarantees one third

Jeonse Fraud Victims Act Article 25-9 (effective 2026-11-13).

  1. Minimum guaranteedeposit × one third
  2. Recoveries and support addeddividends and priority repayment + claim recoveries + public support
  3. Shortfallapply to the Ministry and receive it

If the total already reaches one third, there is no support payment.

On application, the Ministry decides within 90 days whether to pay. If documents need supplementing, the deadline is extended once by up to 30 days. Victims recognized before the effective date can apply from that date.

Who cannot receive it

The application limits in Article 25-9 and repayment under Article 25-11.

  2. No demand for distributionexcluded if no demand was filed in the auction or public sale
  3. After receivingno public rental support · repay if the deposit is recovered

The legal basis

Drawn from government announcements and the statutes themselves as primary sources, covering only the relevant part.

Jeonse Fraud Victims Act Article 25-9 (Minimum guarantee support)

In force Effective 2026-11-13 (promulgated 2026-05-12; Addenda Article 1 proviso)

Where the sum of amounts received through opposability and priority repayment, amounts recovered on the deposit claim, and support under Articles 25, 25-2 and 25-3 falls short of one third of the deposit, a victim may apply to the Minister for the shortfall. Excluded: those who bought the property, those who filed no demand for distribution, and those who received advance payment. Decision within 90 days, extendable once by up to 30 days. Receiving support bars public rental support.

What this means

The gap below one third is filled on application. Omitting a single demand for distribution closes this door.

Jeonse Fraud Victims Act Addenda Articles 4 and 5 (Application)

In force 2026-11-13

Article 25-9 also applies to victims recognized before the effective date. The exclusion for failing to demand distribution applies from the first auction commencement decision or public sale notice after the effective date.

What this means

Victims already recognized can apply. The distribution limit starts with auctions and public sales that begin after the effective date.

Frequently asked

How much is guaranteed on a ₩300M deposit?

The minimum guarantee is one third, ₩100M. If dividends, recoveries and support already received fall short of ₩100M, you apply for the difference.

I have already been recognized as a victim. Can I apply?

Yes. Under the addenda it also applies to victims recognized before the effective date. Apply from that date.

What if I did not file a demand for distribution?

You cannot apply. Anyone who filed no demand for distribution in the auction or public sale is excluded. This limit applies from the first auction commencement or public sale notice after the effective date.

What if I later recover the deposit?

The support received must be repaid up to the amount recovered. Receiving the support also bars public rental support.
