Why it works this way

Today, how much of the deposit comes back is settled only when the auction and distribution end. Until then nothing returns, and a victim who contracted with someone lacking leasing authority can hardly expect a dividend at all. Trust fraud is the typical case.

What changes: pay first, settle later

Jeonse Fraud Victims Act Article 25-10 (effective 2026-11-13).

  1. Eligible victimscontracted with a person lacking lawful authority · trust fraud included
  2. Advance paymentthe minimum guarantee (one third) paid first
  3. Settlementsettled later against dividends and recoveries

If the Ministry takes over the deposit claim, it succeeds to the priority repayment right.

On application the Ministry decides whether to pay and how much within 90 days, extendable once by up to 30 days if documents are supplemented. A tenant who receives the advance must keep opposability until settlement is complete. Moving out and losing opposability breaks the settlement structure.

Relation to the shortfall support: a pair taking effect the same day

Article 25-9 (shortfall support) and Article 25-10 (advance payment).

  1. Shortfall support (25-9)after dividends and support, top up to one third
  2. Advance payment (25-10)one third paid first to specific victims
  3. Bothno overlap with public rental support · repay on recovery

A person who received the advance cannot separately apply for shortfall support.

Receiving the advance bars public rental support.

What this means

One third comes first, without waiting for the auction. In return, the tenant must keep opposability over the home until settlement.

Frequently asked

Who qualifies for the advance?

Victims who contracted with a person lacking lawful authority to lease. Trust fraud victims are the typical case, and others set by Presidential Decree are included.

Do I have to pay the advance back?

It is settled against what you later receive through dividends or recoveries. If you recover the deposit, you repay up to the amount received.

What does keeping opposability mean?

Keeping your resident registration and occupancy at the home until settlement is complete. For the Ministry to take over the deposit claim and exercise priority repayment, the tenant's opposability must remain alive.

Can I also receive the shortfall support?

No. A person who received the advance is excluded from shortfall support, and neither overlaps with public rental support.
