Unpaid wages vanish if you wait and grow if you know — how ₩9M piled up ₩1.73M in a single year
When you leave a job, every amount owed (wages, severance and the rest) must be paid within 14 days, and from the day after that, 20% a year in late-payment interest accrues. The amended law now adds the same interest to wages unpaid while you are still employed, from the day after payday. If the employer cannot pay, the state pays first through the wage guarantee (substitute payment), the limitation period is 3 years, and for deliberate non-payment you can claim up to 3 times the amount in court. Both the interest and the treble claim must be asked for.

Why it works this way
You leave a company after three months without your ₩3M monthly wage. ₩9M. The owner keeps saying it is coming and holds out for a year. How much did you lose in that year? The law adds interest to it, at 20% a year. ₩1.73M has piled up on top of the principal, several times what a bank deposit pays. And since October 2025 a new article has been added: wages deliberately withheld can be claimed in court at up to 3 times. Unpaid wages are money that vanishes for those who wait, and a claim that grows for those who know.
The first step is the 14-day clock. Article 36 of the Labor Standards Act: when a worker leaves or dies, the employer must pay wages, compensation and every other amount owed within 14 days of that day. That means severance, pay for unused annual leave and promised bonuses as well as wages. 'We will pay on the next payday' does not match the law. There is one proviso: with special circumstances the deadline may be extended by agreement between the parties, and that agreement requires the worker's consent. Answering 'all right' to 'please wait a little' can be treated as an extension agreement, so even if you wait, put in writing how much will be paid by when. During employment a separate clock under Article 43 runs: wages must be paid in full, directly, at least once a month on a fixed date, so payday itself is the legal deadline.
14 days from the leaving date is the settlement deadline; from the day after, 20% a year accrues until payment.
- Leaving datewages · severance · leave pay · bonuses all due for settlement
- Day 14settlement deadline (Art. 36)
- From day 1520% a year late-payment interest (Art. 37 · Decree Art. 17)
- One year laterinterest ₩1.73M, ₩4,932 a day
Before the amendment this interest applied only to leavers' wages; the amended law adds the same interest to wages unpaid during employment, from the day after payday. It reaches only arrears arising on or after the commencement date, 23 October 2025.
The exceptions are fixed. While the company is in rehabilitation or bankruptcy proceedings, or where it is appropriate to have a court decide whether the wages are owed at all, interest is paused. And one practical point: this interest does not arrive computed on its own. Whether in a complaint or a lawsuit, you must state that you claim late-payment interest together with the principal. Write only the principal and you receive only the principal.
Third step: what if the owner truly has no money? The Wage Claim Guarantee Act answers. The state pays the unpaid wages in the employer's place and then recovers them from the employer. It is called the substitute payment, in two kinds. First, the insolvency substitute payment: when the company enters rehabilitation or bankruptcy or is recognized as unable to pay, the state pays the last 6 months of wages and the last 3 years of severance (raised from 3 months by amendment, for rehabilitation or bankruptcy decisions or inability findings made on or after 20 August 2026), with a monthly cap set by notice between ₩2.2M and ₩3.5M depending on age at leaving. Second, the simplified substitute payment: even if the company has not failed, a court judgment or a certificate of unpaid wages issued by the labor office is enough. The cap is ₩7M for wages and ₩7M for severance. There are deadlines: a leaver must file the labor office complaint within 1 year, or the lawsuit within 2 years, of the day after leaving. And a current employee who meets the income threshold can also receive it once per workplace for the most recent 3 months of wages. The certificate is the key: file a complaint with the labor office, and once the investigation confirms the arrears, the document is issued and you can apply for the simplified substitute payment without a lawsuit.
The simplified substitute payment covers wages up to ₩7M first; the remainder and the interest go through the courts.
- Unpaid wages (principal)₩9M
- Simplified substitute payment cap · wages₩7M
- One year of interest (20% a year)₩1.73M
The fourth step is three numbers. First, 3 years: a wage claim not exercised for 3 years is extinguished by limitation, and the time you spent waiting counts. The period runs separately from each payday for that month's wages, and a labor office complaint alone does not stop it. That takes a court claim such as a lawsuit or payment order. Second, criminal penalties: violating the 14-day settlement or regular payment carries up to 3 years in prison or a fine of up to ₩30M. Not paying the interest itself carries no criminal penalty. And it cannot be prosecuted against the worker's wishes, so the owner wants a settlement and tries to cut the principal as its price. Declining prosecution is the worker's card, not an obligation, and an employer whose name has been published who violates again during the publication period is an exception and is punished even after a settlement. Third, 3 times: the newly created Article 43-8. Where non-payment was clearly deliberate, wages were unpaid for 3 or more months in a year, or the total is 3 months of ordinary wages or more, the worker may claim up to 3 times the unpaid wages in court. Severance is left out of the treble amount. The court weighs the duration and circumstances, the employer's efforts, interest already paid and assets, so the full 3 times is not automatic. Even so, the price of holding out no longer ends at principal plus interest. The treble claim too reaches only arrears arising on or after the 23 October 2025 commencement.
The checklist. First, gather evidence: the employment contract, pay slips, attendance records, and texts and conversations with the owner. A verbal promise is evidence once recorded. Second, count: list unpaid wages, severance and leave pay item by item, and compute late-payment interest from the day after the legal deadline. Third, file a complaint with the Ministry of Employment and Labor. It is accepted online, a labor inspector investigates and issues a correction order, and if arrears are confirmed the certificate is issued. Fourth, apply for the simplified substitute payment with the certificate (a leaver must have filed the complaint within 1 year of the day after leaving). Amounts within the cap are received here first. Fifth, the remainder, the interest and, for deliberate non-payment, treble damages go through the courts; for small sums there are simplified procedures such as a payment order.
The core of the order is one thing: the 3-year limitation and the clock keep running while you wait. Someone who gathers evidence in the first month of arrears and someone who moves after six months of patience get different outcomes under the same law. Nationality is irrelevant. Foreign workers get the same law and the same substitute payment.
Two things to do now. First, if wages are owed to you, gather the evidence today and calculate principal and interest. The next step starts once the number is in hand. Second, if you have already waited a long time, count the days left before the 3-year limitation. The effect of an extension agreement, the details of certificate issuance and the requirements for treble damages differ case by case, so if the amount is large or the company digs in, move with a labor attorney or lawyer. Unpaid wages are your claim, whatever the owner's circumstances. The law attaches interest to that claim and has even built a road for the state to pay in the owner's place.

근로기준법 제36조 (금품 청산)
In force Statute as in force from 2026-08-20 (checked 2026-08-30)
When a worker leaves or dies, the employer must pay wages, compensation and every other amount owed within 14 days of that day. With special circumstances the deadline may be extended by agreement between the parties.
What this means
The next payday after leaving is not the legal deadline. The clock is 14 days from the leaving date, and an extension takes effect only with your consent.
근로기준법 제37조 · 시행령 제17조·제18조 (지연이자)
In force Art. 37 amended 2024-10-22 (Act No. 20520, Addenda Art. 1, one year after promulgation), in force 23 October 2025 / Decree Art. 17 rate amended 2025-04-08 (checked 2026-08-30)
Wages not paid by the deadline accrue late-payment interest of 20% a year from the day after until payment. For leavers, from the day after day 14 (item 1); for current employees, from the day after the regular payday (item 2). Excluded while grounds set by the Decree, such as rehabilitation or bankruptcy, exist.
What this means
₩9M unpaid for a year piles ₩1.73M on top of the principal. Wages unpaid during employment become an interest-bearing claim too. Under Addenda Art. 2, the current-employee interest applies only where the ground for it arose on or after the 23 October 2025 commencement. Not paying the interest itself has no criminal penalty (Art. 109).

Where non-payment is clearly deliberate (severance excluded), wages go unpaid for 3 or more months in a year, or the total is 3 months of ordinary wages or more, the worker may claim damages in court of up to 3 times the unpaid amount. The court considers the duration, circumstances, frequency and size, the employer's efforts, late-payment interest paid under Art. 37, and assets.
What this means
The price of holding out no longer ends at principal plus interest. But the full 3 times is not automatic. It must be claimed and the court decides. Under Addenda Art. 5 it applies where the employer met one of the listed grounds on or after the 23 October 2025 commencement.

A wage claim not exercised for 3 years is extinguished by limitation.
What this means

Insolvency substitute payment: last 6 months of wages (shutdown allowance and maternity leave pay also 6 months) + last 3 years of severance, monthly cap by age ₩2.2M to ₩3.5M. Under Addenda Art. 2 it applies where a rehabilitation or bankruptcy decision or an inability finding is made on or after 20 August 2026 (3 months before that). The simplified payment goes to workers who sued within 2 years or complained within 1 year of the day after leaving (Decree Art. 7(2)). Simplified substitute payment: with a judgment or a certificate of unpaid wages, wages up to ₩7M and severance up to ₩7M. Current employees who meet the income threshold may also receive the most recent 3 months once per workplace.
What this means
If the owner cannot pay, the state pays first and recovers from the owner. The key is the certificate issued after a complaint to the labor office.

Frequently asked
They say I will be paid on the next payday after leaving. Is that right?
No. Article 36 of the Labor Standards Act requires wages, severance, unused leave pay and every other amount to be paid **within 14 days** of the leaving date. With special circumstances it can be extended with the worker's consent, but an 'all right' can be treated as an extension agreement, so put in writing how much is paid by when.
Does interest accrue on wages unpaid while I am still employed?
Yes. Amended Article 37 adds 20% a year **to wages unpaid during employment, from the day after payday**. Previously it applied only to leavers' wages. It pauses while grounds such as rehabilitation, bankruptcy or a matter properly left to a court exist.
Is the late-payment interest computed automatically?
No. In a complaint or a lawsuit you must **state that you claim late-payment interest together with the principal**. Write only the principal and you receive only the principal. Treble damages must also be claimed in court, and the full 3 times is not automatic.
What if the owner truly has no money?
The state pays in the owner's place. Even if the company has not failed, a judgment or the labor office's **certificate of unpaid wages** lets you apply for the **simplified substitute payment** (wages up to ₩7M · severance up to ₩7M) without a lawsuit; in rehabilitation or bankruptcy there is the **insolvency substitute payment** (last 6 months of wages + 3 years of severance, monthly cap by age ₩2.2M to ₩3.5M). Six months applies to decisions or findings on or after 20 August 2026; earlier ones get 3 months. The simplified payment requires acting within **1 year (complaint) or 2 years (lawsuit)** of the day after leaving.
The owner offers to settle for less, saying a settlement avoids punishment.
Wage arrears cannot be prosecuted against the worker's wishes, which is why the owner wants a settlement. Declining prosecution is **the worker's card, not an obligation**, and an employer whose name has been published who violates again during the publication period is punished even after a settlement.
How long can I claim?
The limitation period for wage claims is **3 years**, running separately from each payday. A labor office complaint alone does not stop it, so if things drag on, stop it with a court claim such as a lawsuit or payment order. The time spent waiting counts toward it, so gathering evidence and moving in the first month of arrears produces a different result from six months of patience.
