Money you get first even at auction — priority payment is set by the table on the mortgage date, not the contract date
A Seoul jeonse tenant with a ₩160M deposit whose home goes to auction receives ₩55M ahead of the bank even though the bank's mortgage ranks first. A tenant in the next block with a ₩170M deposit on the same kind of home receives nothing first. A ₩10M difference splits ₩55M. This is priority payment for small-deposit tenants: if the deposit is within the table's ceiling, the table's amount is paid ahead of any secured creditor, the table is the one in force on the day the bank registered its mortgage rather than the contract date, and the total is capped at half the home's value and shared among several tenants.
Conditions used in the calculation
- Case
- Seoul · deposit ₩160M vs ₩170M · bank mortgage ranks first · auction
- Step ①
- two lines: fixed-date priority (move-in + registration + fixed date · by date) · priority payment on opposability alone (small-deposit tenant within the ceiling · fixed date irrelevant · move-in and registration before the auction filing)
- Step ②
- table (revised 2023-02-21): Seoul ₩165M or less → ₩55M · overconcentration area, Sejong, Yongin, Hwaseong, Gimpo ₩145M or less → ₩48M · metropolitan cities, Ansan, Gwangju, Paju, Icheon, Pyeongtaek ₩85M or less → ₩28M · elsewhere ₩75M or less → ₩25M
- Step ③
- date: the actual case uses the decree table on the mortgage registration date · an old mortgage means an old table · with no mortgage, the table when the auction opens
- Step ④
- cap: total up to half the home's value (land included) · shared pro rata among several tenants · tenants living together like a family count as one
- Where to check
- the mortgage date on the registry · Korea Legal Aid Corporation · jeonse fraud support center
Results
- Seoul ₩160M
- within the ₩165M ceiling → ₩55M first · the remaining ₩105M in the fixed-date line
- Seoul ₩170M
- over the ceiling → no such line (₩10M apart, ₩55M apart)
- Elsewhere ₩75M
- ₩25M
- Home value ₩80M · deposit ₩160M
- cap of half the value, ₩40M
- ₩200M home · three small-deposit tenants
- cap ₩100M ÷ 3 = ₩33.33M each
- The table amount
- a ceiling, not a guarantee
- In one day
- registration + fixed date puts both lines in place

Why it works this way
A Seoul jeonse tenant with a ₩160M deposit sees the home go to auction. The bank's mortgage was registered first, so in the order of distribution the tenant comes after. Yet ₩55M is paid ahead of the bank. In the next block, in the same kind of home, a tenant with a ₩170M deposit receives nothing first. A ₩10M difference splits ₩55M. This is priority payment. If the deposit falls within the table's ceiling, the table's amount is paid ahead of any secured creditor, and the table is not the one at contract time but the one on the day the bank registered its mortgage. Most tenants believe a fixed date makes them safe and sign without knowing the table exists, whether they fall within it, or which date's table applies. It is often assumed small deposits are protected automatically, but over the ceiling there is nothing.
Housing Lease Protection Act Article 3-2(2) · Article 8.
- Fixed-date prioritymove-in + registration + fixed date · ranked by date · behind the bank if the bank came first
- Priority paymenta small-deposit tenant within the ceiling · fixed date irrelevant · ahead of any secured creditor · condition: move-in and registration (opposability) before the auction filing
- Seoul ₩160Mwithin the ₩165M ceiling → ₩55M first · the remaining ₩105M in the fixed-date line
The fixed date is the second line; the first line is registration and moving in, which is where most people get confused. Delay registration and you lose the first line entirely. Register at the community center or through the government app on moving day and get the fixed date on the contract at the same counter, and both lines stand in one day.
Step ② The table, revised 21 February 2023. Seoul: ₩55M for deposits of ₩165M or less. The overconcentration control area, Sejong, Yongin, Hwaseong and Gimpo: ₩48M for ₩145M or less. Metropolitan cities, Ansan, Gwangju, Paju, Icheon and Pyeongtaek: ₩28M for ₩85M or less. Elsewhere: ₩25M for ₩75M or less. Seoul ₩160M gets ₩55M and ₩170M has no line at all, which is where the two tenants in the opening parted. It is a cliff, the line vanishing above the ceiling, and not knowing, tenants set the deposit a little high and throw away the ₩55M line.
Transitional provisions in the addenda to the Enforcement Decree.
- The table changes oftenthe actual case uses the decree table on the mortgage registration date · a home with an old mortgage uses an old table (lower ceiling, lower amount)
- Before signingthe mortgage date on the registry → that day's table · Suikbang calculates with the current table and adds a warning
- A home with no mortgagethe table when the auction opens · the current table is your table
It is someone else's mortgage date, not your contract date, which confuses people. Not knowing, you are inside today's table but outside the old one and have no first line at auction. Check the registry for a mortgage first.
Step ④ The cap is half the home's value, shared among several tenants. The total is up to half the value including land, so even a Seoul ₩160M deposit is capped at ₩40M if the home is worth ₩80M. With several tenants it is shared pro rata: a ₩200M home with three small-deposit tenants gives ₩100M ÷ 3, ₩33.33M each, and tenants living together like a family count as one with deposits combined. The table amount is a ceiling, not a guarantee, which confuses people; not knowing, you receive a third in a multi-unit house. The pre-contract checklist is three lines: ① the mortgage date on the registry → that day's decree table; ② is your deposit within the regional ceiling and what is the amount, negotiating downward if near the ceiling; ③ half the home's value and the number of other tenants, asking about earlier deposits in a multi-unit house. With three lines, the priority-payment check is done; register and get the fixed date on moving day. The whole deposit is the return guarantee in the previous lecture.
All four steps are passed: a separate line, the regional table, the mortgage date, half the value and the tenant count. Seoul ₩160M gets ₩55M and ₩170M gets ₩0 on the table's ceiling. Delay registration and lose the first line, miss the ceiling and lose ₩55M, ignore the date and face the old table. Two things to do now: find the mortgage date on the registry and read that day's table, and negotiate the deposit downward if near the ceiling. Old tables and the scope of the overconcentration area can be checked with the Korea Legal Aid Corporation or the jeonse fraud support center. It is the table on the mortgage date, not the contract date.

Open the Small Tenant Priority Payment
Frequently asked
I have a fixed date. How is priority payment different?
Different. Fixed-date priority is the second line ranked by date, so if the bank came first you are behind it. Priority payment is the first line: a small-deposit tenant within the ceiling who moved in and registered before the auction filing is paid ahead of any secured creditor regardless of the fixed date.
How much comes first on a ₩170M deposit in Seoul?
₩0. The Seoul ceiling is ₩165M, and above it the line does not exist. At ₩160M it is ₩55M.
Do I use the table from when I signed?
No. The actual case uses the decree table on the day the bank registered its mortgage. An old mortgage means an old table with a lower ceiling and amount. Start from the mortgage date on the registry.
Do I receive the full table amount?
It is a ceiling, not a guarantee. The total is capped at half the home's value including land, so a ₩80M home gives ₩40M, and several tenants share pro rata.
What if a multi-unit house has three tenants?
In a ₩200M home with three small-deposit tenants, the ₩100M cap is shared, ₩33.33M each. Ask about earlier deposits before signing.
By when must I register my move-in?
Move-in and registration must be complete before the auction filing to stand in the first line. Register and get the fixed date on moving day and both lines stand in one day.
