Same ₩600K rent, one gets a ₩1.22M rent credit and the desk neighbor gets ₩0 — the difference was the claim, not the rules
The monthly rent tax credit has three layers of conditions (a homeless household head, total salary of ₩80M or less, and a home you are registered at) and takes 17% of your rent (15% above ₩55M of salary) straight off your tax, on up to ₩10M of rent a year. It is never applied automatically: you must claim it, and years you missed can be recovered through an amended-return claim going back 5 years. But claiming it means giving up the ₩130K standard tax credit that employees who claim no special credits receive, so the real gain is the credit minus ₩130K (if you claim no other special credits). From 2026 a spouse living at a different address can claim an additional credit.

Why it works this way
An employee pays ₩600K a month in rent. At year-end tax adjustment, the rent credit cuts their tax by ₩1.22M, which is two months' rent. The colleague at the next desk pays exactly the same rent and gets ₩0 in rent credit. The rules were not different; they simply never claimed. The colleague still gets the ₩130K standard tax credit, so the real gap between them is ₩1.094M. The rent tax credit is not applied automatically. It is calculated only for people who submit the papers and claim it. And the past five years you missed can still be recovered today.
The basis is Article 95-2 of the Restriction of Special Taxation Act, where the conditions, rates and caps are all written as numbers. Four steps: who qualifies, how much, why people miss it, and how to recover missed years. And one thing changed this year: a spouse at a different address can now claim an additional credit.
Step one: three layers of conditions. The person must be head of a household that owns no home as of the last day of the tax year, and an employee with total salary of ₩80M or less. If the household head claims no housing-related deductions a household member can claim instead, and registered foreigners qualify if they meet the conditions. 'No home' is judged for the entire household, not you alone. The home must be national-housing size or smaller, or a standard value of ₩400M or less; officetels and gosiwons count, and households with three or more children or grandchildren got a relaxation to 100㎡ this year. As for the papers, the address on the lease must match your resident registration, meaning you must have registered your move-in. The lease can be in your name or that of a family member who is your basic-deduction dependent.
Pass all three and you move on to the next step, the amount (Enforcement Decree Art. 95).
- ① Personhead of a homeless household · employee with salary ≤ ₩80M (member if the head does not claim · registered foreigners too)
- ② Homenational-housing size or standard value ≤ ₩400M · officetels and gosiwons included · 100㎡ for 3+ children or grandchildren
- ③ Paperslease address = resident registration (move-in registered) · lease in your name or a basic-deduction dependent's
'No home' is judged for the whole household. A family member in the same household owning a home disqualifies you.
Step two: the amount. Total salary sets the rate: 17% up to ₩55M, 15% above ₩55M up to ₩80M. Eligible rent is capped at ₩10M a year. With a ₩50M salary and ₩600K rent, annual rent of ₩7.2M × 17% = ₩1.224M. With a ₩60M salary the rate is 15%, ₩1.08M. If annual rent exceeds ₩10M (₩900K a month, say), only ₩10M counts, so the maximum credit is ₩10M × 17% = ₩1.7M.
Eligible rent up to ₩10M a year. 17% up to ₩55M of salary, 15% above that up to ₩80M.
- ₩600K rent · ₩50M salary (17%)₩1.224M
- ₩600K rent · ₩60M salary (15%)₩1.08M
- ₩900K rent · ₩10M cap × 17% (maximum)₩1.7M
This is a tax credit. Unlike an income deduction that shrinks the tax base, it subtracts the amount straight from the tax already calculated. There is one limit: you cannot get back more than the tax you owe. Someone with a computed tax of ₩300K sees it fall only to zero even if the credit available is ₩1M. If your income carries almost no tax, the credit is worth correspondingly less. One more point: an employee who claims no special credits at all (rent, insurance, medical, education) gets a ₩130K standard tax credit (소득세법 제59조의4 제9항 제1호). Claiming the rent credit removes that ₩130K, so the gain is the credit minus ₩130K: at ₩600K rent on a ₩50M salary, ₩1.224M − ₩130K = ₩1.094M. Anyone already claiming another special credit loses the ₩130K anyway, so the full ₩1.224M is added.
Step three: the reasons eligible people miss out come down to a few. First, they never registered their move-in. If the lease address and the registered address differ, the condition itself collapses. Second, they worry about the landlord. But this credit needs no landlord consent; the lease, your resident registration and bank transfer records are enough. Third, they did not know or found the paperwork tedious. All it takes is handing your employer a copy of the lease and transfer history at year-end, and they skip that one step. Fourth, they assume they do not qualify. Officetel and gosiwon residents, or a lease signed by a basic-deduction dependent rather than yourself, sometimes qualify once checked against the table. At ₩600K rent on a ₩50M salary, a single claim is worth ₩1.094M even after losing the ₩130K standard credit.
Step four: if you paid rent last year and the year before without knowing about the credit, it is not over. An amended-return claim asks the tax office to correct a filing that was wrong or incomplete, and it is allowed within 5 years of the statutory filing deadline. From today that reaches back through the last five year-end adjustments, provided you met the conditions in each year. On Hometax, open the amended-return menu, attach that year's lease and transfer records, and the refund lands in your account after processing. The amount is not the same every year: rates, caps and salary lines follow that year's law. At ₩600K rent on a ₩50M salary it is ₩1.224M a year from the 2022 tax year (the 17% rate reached 2022 adjustments through Addendum Art. 18 of the 2022-12-31 amendment) and ₩864K for 2021, when the rate was 12%. If you received the standard tax credit that year because you claimed no other special credits, that amount comes off the refund. Each year's salary and no-home conditions are also judged for that year. An amended-return claim is a right, and it brings no penalties and no disadvantage.
One more thing, new this year. The credit used to be for the household head alone, but the law was amended (Art. 95-2(2), added 2025-12-23) so that the head's spouse can also claim an additional credit if they meet the conditions. The key condition is a different address: the spouse must live in a different city, county or district from the head. A couple living apart on weekdays because of work is exactly this picture. The combined cap stays at ₩10M a year, so the spouse uses whatever the head leaves unused, and the spouse must still meet the original conditions such as owning no home. The Decree adds further details, so check the table carefully if this applies to you.
Three things to do now. If you rent but have not registered your move-in, do that first, because it is the door to eligibility. For rent paid in 2026, submit a copy of the lease and your transfer history at the January to February 2027 year-end adjustment (the 2026 tax year); the spouse credit also first applies there, since it covers rent paid from 2026. Count whether any of the past 5 years were missed, and if so file an amended-return claim on Hometax. Borderline situations such as household composition or the home's standard value differ from person to person, so when in doubt confirm with the tax office or a tax adviser. The ₩1.094M gap between you and the next desk came down to one bundle of papers, not income or luck.

An employee who heads a homeless household with total salary of ₩80M or less may credit 15% of rent paid (up to ₩10M a year), or 17% if salary is ₩55M or less, against computed comprehensive income tax. Excluded above ₩70M of comprehensive income (₩45M in the ₩55M-or-less bracket).
What this means
At ₩600K rent on a ₩50M salary, ₩1.224M comes straight off your tax. But never more than the computed tax itself, and claiming it forgoes the ₩130K standard tax credit (소득세법 제59조의4 제9항 제1호).

The household head's spouse may also claim an additional rent tax credit if they meet the conditions. Combined cap ₩10M a year.
What this means
A newly opened door for couples living apart in different districts because of work. The cap is not ₩10M each. The spouse shares what remains of it.

A person who filed a tax base return may request a correction within 5 years of the statutory filing deadline.
What this means
Five missed year-end adjustments can be recovered today, each at that year's rate (12% for 2021, 17% from 2022). An amended-return claim is a right, not a confession, with no penalties or disadvantage.

Frequently asked
Do I need the landlord's consent?
No. The lease, your resident registration (move-in) and bank transfer records are all you need. There is no reason to give it up because you agreed at signing not to claim.
With a ₩50M salary and ₩600K rent, how much comes back?
Annual rent of ₩7.2M × 17% = **₩1.224M** comes off your tax. If you claimed no other special credits, you lose the ₩130K standard tax credit, so the gain from claiming is ₩1.094M. With a ₩60M salary the 15% rate gives ₩1.08M, and if annual rent exceeds ₩10M only ₩10M counts, for a maximum of ₩1.7M at 17%.
I pay almost no tax. Do I still get the full amount?
No. A tax credit is subtracted from the computed tax, so you cannot get back more than you owe. With computed tax of ₩300K, a ₩1M credit only brings it down by ₩300K.
Can I recover years before last year?
Yes, through an **amended-return claim** under Art. 45-2 of the Framework Act on National Taxes, within 5 years of the statutory filing deadline. Attach that year's lease and transfer records in the Hometax amended-return menu and the refund goes to your account. Each year's conditions and rate are judged for that year. At ₩600K rent on a ₩50M salary, ₩1.224M from the 2022 tax year and ₩864K for 2021 at 12%, less any standard tax credit you received that year. No penalties or disadvantage.
Can a couple living apart both claim?
Under Art. 95-2(2), added 2025-12-23, the household head's spouse can claim an additional credit if they live in a different city, county or district and meet the original conditions. The combined cap is ₩10M a year, so the spouse uses whatever the head leaves unused.
Do officetels and gosiwons count?
Yes. If the home is national-housing size or smaller, or has a standard value of ₩400M or less, officetels and gosiwons are eligible. The lease address must match your resident registration.
