Same investment, ₩1.54M in tax versus ₩297K — what one account changed, and the 3-year price

An ISA (Individual Savings Account) cuts tax through three devices: netting gains against losses, a tax-free allowance (₩4M for the low-income type, ₩2M for the general type), and 9.9% separate taxation on the excess. The price is a contract term of at least 3 years and contribution caps (₩20M a year, ₩100M in total); withdrawals within principal are allowed even inside the 3 years. After 3 years there are three exits: settle, extend, or transfer to a pension account. But anyone subject to comprehensive taxation of financial income even once in the 3 years before opening or extending gets none of these benefits.

Tax-free allowance: set by account type

Low-income type if prior-year salary ≤ ₩50M with only earned income, or comprehensive income ≤ ₩38M with salary not above ₩50M. The allowance is per contract, not per year (Restriction of Special Taxation Act Art. 91-18(2)).

  • General type₩2M

Why it works this way

Two people invested in the same products in the same year and earned exactly the same: ₩10M in interest and dividends, and a ₩3M loss on another product. When the tax was worked out, one owed ₩1.54M and the other ₩297K, five times less. What differed was the account. One bought in an ordinary brokerage account, the other in an ISA, the account nicknamed the 'do-everything account'. But the name carries some exaggeration. It is not a free perk. It is a contract that trades three years of your time for the benefits.

The ISA, the Individual Savings Account, is a tax-advantaged account created by Article 91-18 of the Restriction of Special Taxation Act, and its benefits and conditions are all written in the law as numbers. Four steps: the account's shape, the three devices that cut tax, the price (three years and the caps) and the exits after year three.

Step one: the shape. Anyone 19 or older can open one, or 15 and older with earned income in the prior year. The rule is one account per person across all financial institutions. It can hold deposits and savings, funds, derivative-linked securities and domestic listed shares, and that breadth earned the nickname. There are two types: low-income if the prior year brought only earned income with salary of ₩50M or less, or comprehensive income of ₩38M or less with salary not above ₩50M; general otherwise. The type sets the tax-free allowance: ₩4M for low-income, ₩2M for general. Eligibility is judged at opening and at extension, and the tax office verifies income and notifies the institution. And some people are shut out: anyone whose financial income exceeded ₩20M, making them subject to comprehensive taxation, even once in the 3 years before opening or extending gets no ISA tax benefit.

Step two, the anatomy of the hook. In an ordinary account, 15.4% is withheld on interest and dividends, and losses are not recognized. Earn ₩10M on one product and lose ₩3M on another, and the tax is on the full ₩10M earned: ₩1.54M. The ISA calculates in a different order. Device one, netting: as of the closing date, only the net profit (all gains minus all losses inside the account) counts. ₩7M. Device two, the tax-free allowance: for the low-income type, ₩4M of that carries zero tax. Device three: the remaining ₩3M is taxed not at 15.4% but at 9%, 9.9% with local tax. ₩297K.

How an ISA calculates: the three devices

₩10M gain · ₩3M loss · low-income type.

  1. ① Netting₩10M − ₩3M = net profit ₩7M (as of closing)
  2. ② Tax-free allowancefirst ₩4M tax-free for the low-income type
  3. ③ 9.9% separate taxationremaining ₩3M × 9.9% = ₩297K

The tax is worked out once, on the day the account is closed, not every year. The 9.9% is separate taxation, so it never counts toward the comprehensive taxation of financial income that kicks in above ₩20M. But anyone subject to that comprehensive taxation even once in the 3 years before opening or extending gets no ISA benefit at all (Restriction of Special Taxation Act Art. 129-2).

Tax on the same investment: ordinary account vs ISA

₩10M interest and dividend gain · ₩3M loss. Saved ₩1.243M = ₩297K from netting + ₩946K from the rate gap.

  • Ordinary account (₩10M × 15.4%)₩1.54M
  • Low-income ISA (₩3M × 9.9%)₩297K

Step three: the price. The first condition is time. The contract must run at least 3 years, and closing before then claws back the tax benefits you received; only unavoidable reasons such as death or emigration are exempt. There is a lesser-known rule, though: even within the 3 years you can withdraw up to the principal you paid in. What the law treats as early closure is withdrawing more than you contributed. The second condition is the cap: ₩20M a year, with unused room carrying to the next year up to ₩100M in total. Miss the ₩20M in year one and year two allows ₩40M. Third, the tax-free allowance is per contract, not per year. The low-income ₩4M is not ₩4M every year but ₩4M applied once to the net profit up to closing. This account settles once, at maturity, in one large calculation.

Step four: the exits. After 3 years, three paths open. First, close and settle: net profit minus the allowance, taxed at 9.9%, done. Second, extend: you can lengthen the term before maturity, with low-income status re-assessed on income at extension. Third, move the balance into a pension account: after 3 years, putting all or part of the balance into pension savings or an IRP counts as maturity, and 10% of the transferred amount, up to ₩3M, is added to that year's pension contributions eligible for the tax credit. That portion is recognized separately from the credit cap covered in the pension episode. So the account's life is not 3 years but a cycle.

An honest calculation. Three kinds of people benefit greatly: deposit and savings-focused investors, whose 15.4% on interest drops to zero or 9.9%; investors in dividend stocks, bonds and overseas index funds, whose dividends and distributions are all subject to netting and the allowance; and people close to the comprehensive financial-income threshold, for whom the separate-taxation effect can outweigh the rate gap, provided they have not crossed it even once in the 3 years before opening. Where the effect is limited: people chasing only capital gains on domestic listed shares. For minority shareholders those gains are mostly untaxed even in an ordinary account, so on gains alone the ISA adds little, though the dividend benefit and netting share losses against other gains remain. The single test is this: how much is the 15.4% currently attached to your financial income costing you per year?

Two things to do now. Check the tax attached to last year's interest and dividends. That 15.4% is the size of your reason to open one. If you open one, first check whether you qualify for the low-income type. At ₩50M of salary or less the allowance doubles. Product choice, fees and maturity settlement vary by institution and circumstance, so read the terms yourself when opening. The reality behind the 'do-everything' name is not magic but a contract that trades three years for three devices.

The legal basis

조세특례제한법 제91조의18 제1항

For residents aged 19 or over (15 or over with earned income in the prior tax period), ISA income above the tax-free allowance is taxed separately at 9% and not combined into comprehensive income.

What this means

Even the excess is taxed at 9.9% (with local tax), not 15.4%, and it never feeds into comprehensive taxation of financial income. The tax is computed and withheld on the closing date (paragraphs 5 and 6).

Savings tax privileges including the ISA (Art. 91-18) do not apply to anyone whose interest and dividend income exceeded the comprehensive taxation threshold (₩20M) at least once in the 3 tax periods before the period containing the opening or extension date.

What this means

It is not the biggest device for people with large financial income. Cross ₩20M even once in the last 3 years and there is no ISA benefit at all.

Tax-free allowance: ₩4M for the low-income type, which means (a) prior-period salary ≤ ₩50M with only earned income (or earned income plus separately taxed income), (b) comprehensive income ≤ ₩38M with salary not above ₩50M, or (c) farmers and fishers. The general type gets ₩2M.

What this means

The type doubles the allowance. That is why you check low-income eligibility before opening.

One account per person. Eligible assets include deposits, savings, funds, derivative-linked securities and domestic listed shares. Contract term at least 3 years. Total contribution cap ₩100M; annual cap = ₩20M × (1 + years elapsed, max 4) − cumulative contributions.

What this means

Unused annual room carries forward, so missing year one still allows ₩40M in year two. Three years is the statutory minimum term.

The contract term may be extended (low-income status re-assessed on income at extension). Income is computed by netting gains and losses inside the account as of the closing date.

What this means

Unlike an ordinary account that ignores losses, only net profit is taxed. The reckoning happens once, at maturity.

Closing before the 3-year term claws back the tax relieved. Exceptions for unavoidable reasons such as death or emigration.

What this means

Three years is the account's price. If you expect to break it within a few years, better not to open it.

Only withdrawals exceeding the principal paid in are treated as early closure. Withdrawals within principal are allowed.

What this means

Your money is not locked for the full 3 years. If you need cash, you can take it out up to the principal.

Transferring all or part of the balance to a pension account after the 3-year term counts as maturity. The transferred amount counts as pension contributions, and the lesser of 10% of it or ₩3M is added to the credit-eligible cap (소득세법 제59조의3 제3항·제4항).

What this means

The lesser-known third exit. 10% of the transfer, up to ₩3M, is added to the pension-side credit base, turning the account's life from 3 years into a cycle.

Frequently asked

If I take money out within 3 years, do I always lose the benefits?

No. What the law treats as early closure is **withdrawing more than the principal you paid in**. Within principal you can withdraw even inside the 3 years. Closure for unavoidable reasons such as death or emigration is also exempt.

Where do ₩1.54M and ₩297K come from?

The example is ₩10M of interest and dividend gains with a ₩3M loss. An ordinary account ignores the loss: ₩10M × 15.4% = ₩1.54M. A low-income ISA takes net profit of ₩7M, exempts ₩4M, and taxes the remaining ₩3M × 9.9% = ₩297K.

Who qualifies for the low-income type?

Prior-year salary of ₩50M or less with only earned income, or comprehensive income of ₩38M or less with salary not above ₩50M, gives the low-income type (₩4M allowance); otherwise it is the general type (₩2M). It is judged at opening and at extension, and the tax office verifies income and notifies the institution. But anyone subject to **comprehensive taxation of financial income** even once in the 3 years before opening or extending gets no ISA benefit, whatever the type.

Is it worth it if I only trade domestic shares?

The effect is limited, because minority shareholders' capital gains on domestic listed shares are mostly untaxed in an ordinary account too. The dividend benefit and the ability to net share losses against other gains remain.

What happens to contribution room I did not use?

Unused room from the ₩20M annual cap carries to the next year. Miss year one and year two allows up to ₩40M, up to a ₩100M lifetime total.

What can I choose after 3 years?

Three exits: close and settle (net profit − allowance → 9.9%), extend (low-income status re-assessed on income at extension), or transfer the balance to pension savings or an IRP (counts as maturity, and 10% of the amount, up to ₩3M, is added to credit-eligible pension contributions). Which is better depends on your age and cash plans.
