Giving versus leaving — how the same ₩500M splits between a gift and an inheritance

Parents with ₩2B to pass on pay ₩232.8M if they simply leave it as an inheritance. Gifting ₩500M to a child now and leaving the rest ten years later totals ₩164.9M, a ₩67.9M saving, but if the inheritance opens five years after the same ₩500M gift the total is back to ₩232.8M. Which is cheaper is not set by the amount. Four steps decide it: the rate table is identical, the ten-year add-back, the market value fixed on the gift date, and the deductions that make a plain inheritance cheapest below ₩1B.

Why it works this way

Parents have ₩2B to pass on. Left alone and inherited, the tax is ₩232.8M. Gifting ₩500M to a child now and leaving the rest ten years later brings the total to ₩164.9M, ₩67.9M less. But if the same ₩500M is given and the inheritance opens five years later, the total is back to ₩232.8M and nothing was saved. Whether giving or leaving is cheaper is not set by the amount but by the date and the nature of the asset. Most people either believe a gift is always cheaper or give up because it is added back anyway; both are half right, staring at the rate table without knowing what they missed. A gift is cheaper under three conditions, all of them about time. As of 2026-09-05 the estate-tax method applies and the reform has not passed.

Step ① The rate table is identical. What differs is the deduction

Inheritance and Gift Tax Act Articles 26, 53, 19 and 21.

  1. Rates10% up to ₩100M to 50% above ₩3B, the same five steps · the rate on ₩500M is the same for a gift or an inheritance
  2. Inheritanceonce on the whole · lump sum ₩500M + spouse ₩500M · ₩2B → deductions ₩1B · taxable ₩1B · ₩232.8M
  3. Giftper recipient · adult child ₩50M · ₩500M gift → ₩450M × 20% → ₩77.6M

This step alone makes the gift look expensive. Stop here and you miss the three steps behind it.

Step ② The ten-year add-back is where the two results in the opening parted. If the inheritance opens within ten years for an heir, five for a grandchild, the gift goes back into the estate; inheritance tax is computed on the total and the gift tax paid is credited. Gift ₩500M and inherit five years later and it comes back, ₩232.8M again, nothing saved. Ten years later, ₩1.5B less ₩1B of deductions leaves ₩500M taxable, ₩87.3M, plus ₩77.6M gift tax for ₩164.9M, a ₩67.9M saving. Most people stumble here: a single day flips it. The earlier the gift the better; starting late means paying gift tax first with no saving.

Step ③ Value fixed: an appreciating asset saves even when added back

Inheritance and Gift Tax Act Article 60(4) · assuming 3% annual growth.

  1. Left aloneover ₩2.7B after 11 years · tax ₩530.96M
  2. ₩500M gifted nowfixed at ₩500M · total after 11 years ₩340.02M · ₩190.94M saved
  3. Even added back after 5 years₩500M stays ₩500M · ₩30.9M saved

Even when added back, it is at the gift-date value and later gains stay out. A depreciating asset makes the gift a loss. Not knowing this, people delay the asset that will rise and give first the one that will fall.

Step ④ Where the deductions sit is below ₩1B. With a spouse and children there is no inheritance tax up to ₩1B, so below ₩1B a plain inheritance is cheapest. A gift deducts only ₩50M before tax: on an ₩800M estate, gifting ₩300M costs ₩38.8M while leaving it costs ₩0. On top of that, the inheritance deduction limit can be cut by what was given early. A gift earns its keep only from estates above ₩1B where tax arises. Most people have the order backwards, paying ₩38.8M they need not and losing deductions. Your decision sheet is three lines. ① Does the estate exceed ₩1B; if not, plain inheritance. ② Is the asset appreciating; if so, gift; if not, no. ③ Can the parents' age clear the ten-year line; even if not, an appreciating asset keeps the fixed-value saving. Who gets how much follows the ten-year combination rule, filing is within three months, and write the gift date down as a family.

All four steps are passed: the rate table is the same, within ten years it comes back, the value is fixed, and below ₩1B it is a loss. The family that gave ₩500M early saved ₩67.9M, or ₩190.94M on an appreciating asset; start late and you pay gift tax first, hurry below ₩1B and you pay ₩38.8M. Two things to do now: note whether the estate exceeds ₩1B and whether the asset appreciates, and count the ten-year line from the parents' age to set the timing. Growth rates are unknown and deduction cuts vary by asset, so consult a tax adviser.

Frequently asked

Are gift tax and inheritance tax rates different?

No. The five steps from 10% up to ₩100M to 50% above ₩3B are the same. What differs is the deduction: ₩500M lump sum plus ₩500M for a spouse on an inheritance, ₩50M for an adult child on a gift.

Is gift tax paid twice if the inheritance opens after five years?

No. The gift is added to the estate, inheritance tax is computed, and the ₩77.6M gift tax paid is credited. The total simply equals the ₩232.8M of a plain inheritance.

Is there any benefit when it is added back?

Yes, for an appreciating asset. It is added back at the gift-date value, so later gains stay out. On a ₩2B estate growing 3% a year, gifting ₩500M now saves ₩30.9M even if added back after five years.

Is a gift better on an ₩800M estate?

No. With a spouse and children there is no inheritance tax up to ₩1B, so leaving it costs ₩0. Gifting ₩300M early costs ₩38.8M and can cut the inheritance deduction limit.

How many years for a grandchild?

Five years for a non-heir grandchild. But a generation-skipping gift carries a surcharge.

Does the inheritance-acquisition reform change this?

There is a government proposal, but as of 5 September 2026 it has not passed. This page uses the current estate-tax method.
