Why it works this way

Today, inspectors under Article 101 of the Labor Standards Act exist only within the Ministry of Employment and Labor. The State handles all workplace inspections and complaint cases such as unpaid wages, and the kinds of inspection and the manner of visits have been set by internal rules rather than statute.

Frequently asked

Will local government inspectors appear on the effective date?

The Act says inspections may be delegated and provinces may appoint local labor inspectors. Being discretionary, it takes the decree setting the scope and procedure and each province's own decision before they actually exist.

Which workplaces would fall under local inspection?

The delegable scope is inspection of workplaces under 30 employees. Whether and how far delegation happens is set by decree and by each province.

Does unannounced mean no prior notice?

Unannounced visits are the rule for workplace inspections. All three kinds, regular, occasional and special, sit under that rule.

Where do I report unpaid wages?

Complaint cases are handled by the regional labor office as a rule. Report to the labor office as before.

Results are estimates based on the inputs and on the rules as at the stated date. They may differ from a lender's actual assessment, and the rules change often. Take professional advice before any decision that matters.
